The law, followed by the Founding Document and the Constitution according to their hierarchy, shall prevail. A subordinate provision may not be interpreted so as to defeat a superior provision.

Article 4: Definitions

In these Regulations: Authority means the Constitutional Oversight and Interpretation Authority; application means a claim, referral or request for interpretation; challenged decision means any decision or procedure attributed to a Party organ; and institutional dispute means a genuine dispute concerning jurisdiction or legality between two or more organs.

Article 5: Objectives

These Regulations seek to uphold Party legality, protect democratic rights, prevent encroachment by one organ upon another, secure consistent interpretation, and provide an independent and prompt internal process for resolving disputes before they escalate.

Article 6: Principles of Review

Review shall be founded on independence, impartiality, legality, proportionality, equality of arms, prompt determination, publication of governing principles, protection of confidential information and respect for the binding force of decisions.

Chapter Two Constitutional Oversight Authority

Article 7: Establishment of the Authority

A permanent independent body known as the Constitutional Oversight and Interpretation Authority is hereby established. It shall exercise its functions without direction from the executive leadership or any party to a dispute.

Article 8: Composition

The Authority shall consist of an odd number of not fewer than five members. The Constitution or the instrument establishing it shall prescribe their number and method of selection, having regard to legal and institutional competence, diversity and the prevention of control by any single organ.

Article 9: Qualifications for Membership

A member shall possess integrity, independence and appropriate experience, and shall not serve simultaneously on the National Executive Bureau, a disciplinary or appeals body, or an election administration body.

Article 10: Term of Office

The term of office shall be prescribed by the Constitution. A member may complete an application reserved for decision when that term expires unless the Authority determines otherwise to protect impartiality.

Article 11: Safeguards of Independence

A member may be removed or suspended only for serious cause and through an independent procedure providing notice, an opportunity to respond and a right of appeal. The Authority's resources shall not be reduced for the purpose of influencing a pending matter.

Article 12: Chair and Rapporteur

The members shall elect from among themselves a Chair, Deputy Chair and Rapporteur. The Chair shall manage procedure without directing members' conclusions; the Rapporteur shall maintain the register, notifications and decisions.

Article 13: Declaration of Office

Before taking office, every member shall sign a declaration of independence, impartiality, confidentiality, disclosure of interests, and refusal of instructions or benefits connected with the Authority's work.

Article 14: Recusal and Disqualification

A member shall recuse himself or herself where there is an interest, relationship, hostility or prior participation in the matter. A party may seek disqualification on stated grounds, and the Authority shall decide without the participation of the member concerned.

Article 15: Vacancy

A vacancy shall be filled by the same method as the original appointment within a reasonable time. A qualified alternate may serve where vacancy or recusal would otherwise deprive the Authority of a quorum.

Article 16: Resources and Support

The Party shall provide the Authority with a budget, secretariat, secure record system and independent technical expertise. No document or resource necessary to its work may be withheld.

Chapter Three Jurisdiction of the Authority

Article 17: Constitutional Review

The Authority shall determine whether Party regulations, decisions and procedures comply with the Founding Document and the Constitution and may invalidate or suspend any inconsistent measure within the limits of these Regulations.

Article 18: Interpretation of the Constitution

The Authority shall interpret ambiguous or conflicting provisions and determine their meaning and scope. Interpretation may not create a rule contrary to express wording or alter the prescribed institutional balance.

Article 19: Conflicts of Jurisdiction

The Authority shall determine positive or negative jurisdictional conflicts between Party organs and specify the competent organ and any steps required to maintain continuity of work.

Article 20: Disputes between Organs

The Authority shall determine disputes threatening institutional order or the legality of decisions after institutional consultation has been exhausted where practicable. It may propose a settlement consistent with the Constitution.

Article 21: Validity of Composition and Quorum

The Authority may review the lawful composition or quorum of an organ and its decision-making procedure where a defect is substantial and material to the outcome, without reconsidering political merits.

Article 22: Protection of Party Rights

The Authority may hear an allegation that an institutional decision violated a fundamental membership right where no adequate special appeal exists or where the dispute concerns the constitutionality of the governing rule itself.

Article 23: Election Oversight

The Authority shall not replace election or electoral appeals bodies, but has jurisdiction over general constitutional questions, excess of jurisdiction by such bodies, or denial of an essential constitutional safeguard.

Article 24: Excluded Matters

The Authority shall not determine abstract political disagreement, the merits of policy choices, or matters pending before a competent disciplinary or electoral body, except to the extent that a constitutional question is necessary for determination.

Article 25: Incidental Jurisdiction

The Authority may determine preliminary questions necessary to its jurisdiction and obtain technical advice, but may not delegate the power to issue the final decision.

Chapter Four Initiating Review and Admissibility

Article 26: Standing

An application may be brought by an interested Party organ, by the number of members prescribed by the Constitution, or by a member directly affected in a right. A disciplinary or appeals body may refer a constitutional issue necessary to its decision.

Article 27: Form of Application

An application shall be in writing and identify the parties, facts, provisions relied upon, challenged decision, relief and evidence. Proof of standing and notification shall be attached. A non-material defect may be cured within a period fixed by the Authority.

Article 28: Time for Challenge

A challenge shall be lodged within thirty days of official notice of the decision. The Authority may admit a late application for compelling cause or where a continuing violation concerns fundamental Party legality, giving reasons.

Article 29: Abstract Interpretation

A request for abstract interpretation is admissible only from an authorised organ and where an actual dispute over the provision affects the exercise of a power or right. The Authority shall not give advisory opinions on hypothetical questions.

Article 30: Preliminary Examination

Within seven days the Chair, or a panel designated by the Authority, shall examine jurisdiction, standing, time and arguability, and may request completion or refer the matter to the competent procedure.

Article 31: Inadmissibility

An application shall be dismissed where standing or interest is absent, the issue has already been decided, or an available special remedy has not been exhausted without justification. Reasons shall be given and one internal request for review may be made.

Article 32: Abusive Applications

A manifestly abusive application, or a repetitive application raising nothing new, may be rejected after the applicant is allowed to explain. Any sanction shall be imposed only under the Disciplinary Regulations and their safeguards.

Chapter Five Proceedings and Determination

Article 33: Notification and Response

The application shall be notified to the parties and affected organs. Each shall have at least seven days to respond, subject to reduction for necessity without impairing the right of defence.

Article 34: Submissions and Evidence

Submissions and documents shall be filed within the prescribed periods. The Authority may require records, hear persons and appoint an expert. Material evidence shall be disclosed to the parties unless lawful confidentiality prevents disclosure.

Article 35: Burden of Proof

An applicant seeking invalidation shall establish the breach and its effect. The decision-making organ shall establish jurisdiction and procedural regularity where the relevant records are within its control. The Authority may draw appropriate inferences from unjustified non-production.

Article 36: Hearings

The Authority may decide on the papers or after an in-person or electronic hearing. Hearings shall be open to Party members unless protection of persons, investigations or data requires a closed hearing by reasoned decision.

Article 37: Right to be Heard

Every party has the right to know and answer the claims, present its case and receive assistance of its choosing. A decision shall not rest on a material ground the parties had no reasonable opportunity to address.

Article 38: Consolidation

Related applications may be consolidated, or a common preliminary issue determined, where this serves justice without delay or prejudice to the parties.

Article 39: Quorum and Deliberation

A majority of all members constitutes a quorum. Deliberations are confidential and decisions are made by a majority of those present. A reasoned dissent shall be recorded at the dissenting member's request.

Article 40: Time for Decision

The Authority shall decide within thirty days after the file is complete. It may extend once for an equal period by a decision explaining complexity or the need for further evidence.

Article 41: Conciliation and Mediation

The Authority may offer mediation in institutional disputes capable of settlement. A settlement may not validate an express constitutional breach or waive a fundamental right. Once recorded and approved, it is binding.

Chapter Six Interim Measures and Decisions

Article 42: Stay of Execution

The Authority may temporarily stay a decision where there is a serious arguable basis and a risk of irreparable harm, balancing the parties' interests and Party continuity. The order shall be reasoned and time-limited.

Article 43: Protective Measures

The Authority may order preservation of records, suspension of a specified procedure or continuation of an essential service without deciding the merits or replacing the executive organ.

Article 44: Contents of a Decision

A decision shall state the composition of the Authority, facts, claims, reasons, applicable provisions, operative order, consequences and implementation period. It shall be signed by participating members and notified to the parties.

Article 45: Forms of Relief

The Authority may reject or dismiss an application, declare validity, interpret a provision, invalidate a decision in whole or part, remit it to the competent organ, determine jurisdiction, or require corrective action.

Article 46: Effect of Invalidation

Invalidation takes effect from the date of the decision unless the Authority prescribes prospective effect to protect stability and rights acquired in good faith. Prospective effect shall not preserve a continuing breach after judgment.

Article 47: Cure of Procedural Defect

Where a defect can be cured, the Authority may remit the matter to the originating organ specifying the required procedure and time. Remittal does not approve the substance of the decision.

Article 48: Binding Force of Interpretation

Principles and interpretations issued by the Authority bind Party organs and members from publication unless the provision is amended or the Authority departs from precedent for publicly stated substantial reasons.

Article 49: Finality

Decisions of the Authority are final within the Party, without prejudice to recourse to competent public authorities or courts where the law permits. No Party organ may suspend or reconsider their merits.

Article 50: Correction and Subsequent Clarification

Within fifteen days of an application, the Authority may correct clerical errors or clarify an ambiguous operative order without changing the substance of the judgment.

Chapter Seven Enforcement Publication and Records

Article 51: Duty to Implement

The organ concerned shall implement the decision within the prescribed period and file a documented compliance report. The Authority may seek clarification or issue a supplementary order necessary for implementation.

Article 52: Failure to Implement

Deliberate refusal to implement, or evasion of, a decision constitutes serious misconduct and shall be referred to the disciplinary body. The Authority shall neither impose the sanction nor combine adjudication with accusation.

Article 53: Publication of Decisions

Final decisions and their principles shall be published in a register accessible to members after redaction of personal or confidential information. A summary of interim orders may be published where the institutional interest so requires.

Article 54: Precedent Register

The Authority shall maintain a subject-matter register of interpretations, principles and departures from them, and later decisions shall identify relevant precedents to promote consistency.

Article 55: Confidentiality and Data Protection

Files shall be held securely and accessed only by authorised persons. Retention and destruction periods shall follow the Data Protection Regulations. Internal deliberations remain confidential.

Article 56: Annual Report

The Authority shall submit an independent annual report stating the number and types of applications, disposal times, implementation levels and institutional recommendations, without disclosing protected data or commenting on pending matters.

Chapter Eight Transitional and Final Provisions

Article 57: Interim Authority

Until the permanent Authority is constituted, the Preparatory Committee shall establish an independent interim authority comprising persons who did not participate in the decision under review. Its mandate ends upon constitution of the permanent Authority and transfer of the records.

Article 58: Pending Applications

Upon commencement, Party organs shall transfer unresolved constitutional applications to the Authority. Valid prior procedures shall be preserved unless the Authority considers completion necessary.

Article 59: Non-retroactivity of Sanctions

A new interpretation shall not support a sanction for earlier conduct consistent with the settled interpretation at the time, without prejudice to removing the continuing institutional effects of a breach.

Article 60: Amendment

These Regulations may be amended by the authority and procedure applicable to their adoption, after obtaining the Authority's opinion on provisions affecting its independence or procedural safeguards.

Article 61: Periodic Review

These Regulations shall be reviewed at least every four years in light of experience and reports. Members and organs shall be invited to submit proposals, and reasons for material amendments shall be published.

Article 62: Legal Review

Before final adoption or official filing, these Regulations shall undergo legal review for consistency with applicable Sudanese law and political-party registration requirements.

Article 63: Adoption and Commencement

These Regulations remain a draft until adopted by the Founding Convention and shall enter into force on the date of adoption unless the adopting resolution specifies a later date.

[50
post-256","party_document","type-party_document","status-publish","hentry
["GET
